GATX Capital Corporation v. Fleet Capital Corporation, 1998 WL 410887 (N. D. Cal. 7/17/98). LANGUAGE CONSTRUCTION. In a duel of two industry giants, GATX, as successor to Itel and Fleet, as successor to Industrial Leasing, duked it out over a fairly simple issue: Is a renewal a "re-leasing" so as to permit GATX to recover remarketing fees. The court found the language of the contract unambiguous and said "No" in several pages.
