Major California Legislation Enacted in 1997 Relating to Pesticides

Legislation of Interest--Pesticide Registration
Under existing law, pesticide manufacturers, importers or dealers must obtain a certificate of registration from the Department of Pesticide Regulation before offering a pesticide for sale in California. Senate Bill 365 (Ch. 530) authorizes the Department to adopt regulations allowing the sale of certain liquid chemical sterilants used on medical devices without registration.
More broadly, Senate Bill 445 (Ch. 691) authorizes the Department to exempt any pesticide from registration that EPA has exempted pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act. The Department must individually evaluate each substance and concur in EPA's decision to exempt it. The Department must exclude from its exempting regulation any specific California requirements that may otherwise be applicable and are necessary to protect health or the environment.
Senate Bill 464 (Ch. 428) requires the Department to implement a program by January 1, 1999 for expedited registration of pesticides classified by EPA as antimicrobial or public health pesticides that the Department determines have human health protection benefits that warrant expedited processing.
