  • Your weight has a direct effect on the amount of alcohol you can consume before you are considered D.U.I. Do not drink on an empty stomach. Drinking an empty stomach speeds the rate of alcohol absorption. Drinking alcohol with carbonated beverages also increases the speed of alcohol absorption into the blood stream.


  • Persons convicted of driving a commercial vehicle with a blood alcohol level of .04 or above, driving a commercial motor vehicle while under the influence of alcohol or controlled substances, or driving a commercial motor vehicle while in possession of a controlled substance shall be disqualified from operating a commercial vehicle for a period of one year.


  • Blood may be withdrawn to determine if a driver is impaired by authorized medical personnel in D.U.I. cases involving serious bodily injury or death with the use of reasonable force by the arresting officer, even if the driver refuses.


  • If you are arrested for D.U.I. and your license is confiscated by the arresting agency, you have 10 days from the date of your arrest to request an Administrative Hearing with the Department of Highway Safety and Motor Vehicles. This hearing is the only avenue you have to possibly receive temporary permits to drive during the period of time your charges are resolved, or to possibly have your license returned if the hearing officer finds that no probable cause existed for the stop.
